Important Notice
By approving a proposal, confirming a project, signing an agreement, making any advance or full payment, or authorizing Brandtisers Media to commence work, the Client confirms that this Refund & Cancellation Policy was made available to them and that they have read, understood and accepted its terms.
This Policy shall be read together with the applicable proposal, quotation, invoice, Terms & Conditions and any written service-specific agreement issued by Brandtisers Media.
- GENERAL APPLICATION
1.1 Scope of Policy
This Refund & Cancellation Policy applies to all services provided by Brandtisers Media, including but not limited to digital marketing, social media management, graphic design, video and reel production, AI-assisted content, Meta Ads, Google Ads, Search Engine Optimization, Google Business Profile management, branding, website design and development and related professional services.
1.2 Approved Service Scope
Refund or cancellation eligibility shall be determined according to the approved proposal, quotation, package, invoice, project status and the amount of work already commenced or completed at the time the cancellation request is received.
- CANCELLATION BEFORE COMMENCEMENT OF WORK
2.1 Eligibility for Cancellation
The Client may request cancellation before project planning or execution has commenced.
A refund may be considered only where no material project-related work has started, including research, strategy, onboarding, team allocation, campaign setup, content planning, creative production, design, development or any other activity relating to the approved scope.
2.2 Deductions from Eligible Refund
Where a refund is approved before commencement of work, Brandtisers Media reserves the right to deduct any payment gateway charges, transaction charges, third-party expenses or other costs already incurred in relation to the Client’s project.
Only the remaining eligible amount, after such deductions, shall be considered refundable.
- NON-REFUNDABILITY AFTER COMMENCEMENT
3.1 Commencement of Services
Work shall be considered commenced once Brandtisers Media has initiated any project-related activity, including but not limited to research, planning, strategy preparation, onboarding, team allocation, content planning, script development, design work, video production, campaign setup, account optimization, website planning or development.
3.2 Non-Refundable Payments
Once project planning or execution has commenced, all applicable advance payments, retainers and service fees shall become non-refundable because Agency time, personnel, production capacity and operational resources have already been allocated.
3.3 Circumstances Not Qualifying for Refund
No refund shall be provided where cancellation, discontinuation or dissatisfaction arises due to a change of mind, Client-side delay, missing information, delayed feedback, delayed approval, failure to provide account access, internal changes within the Client’s business, personal preference after commencement of work or early discontinuation of an active service cycle.
Dissatisfaction based solely upon subjective preference shall not create an automatic right to refund where the Agency has performed work in accordance with the approved scope, brief or instructions.
- MONTHLY SERVICES AND ACTIVE SERVICE CYCLES
4.1 Advance Service Payments
Unless otherwise agreed in writing, recurring monthly service fees are payable in advance before the relevant service period begins.
Once work for an active service cycle has commenced, fees paid for that cycle shall remain non-refundable.
4.2 Client-Side Delays
A delay or interruption caused by the Client’s failure to provide approvals, information, assets, credentials, access or timely communication shall not extend the original billing or service period.
No refund, deduction or financial adjustment shall be applicable for operational time lost as a result of such Client-side delays.
4.3 Unused Services and Deliverables
Posts, reels, stories, designs, campaign days, service quantities or other deliverables allocated to a specific monthly service cycle are intended for use within that active cycle.
Any deliverable remaining unused due to delayed approvals, non-response, missing information, Client postponement or voluntary non-use shall not automatically carry forward, accumulate or convert into a refund, credit or deduction.
Any exceptional carry-forward shall be valid only where separately approved in writing by Brandtisers Media.
- CREATIVE SERVICES, REELS AND VIDEO PRODUCTION
5.1 Included Revisions
Minor corrections and reasonable revisions shall be provided only to the extent included within the approved proposal or service package.
5.2 Complete Change of Approved Work
A complete change of design direction, concept, script, reel structure, video direction, visual style or previously approved creative shall not be treated as a standard revision.
Where a Client requests a complete replacement, remake or recreation after production has commenced or been completed, such request may be treated as a separate Change Request and may involve additional charges.
5.3 Completed Deliverables
Where a reel, video, design or other creative deliverable has already been produced in accordance with the approved direction, it shall be treated as a completed or utilized deliverable for the purpose of the applicable package.
A subsequent request to replace or recreate such deliverable shall not create an entitlement to a refund, service credit or adjustment of the original deliverable quantity.
- AI-ASSISTED CONTENT AND VIDEO SERVICES
6.1 Commencement of AI Production
AI-assisted work shall be considered commenced once research, scripting, prompt development, generation, editing, voice processing, visual production or other creative execution has begun.
Payments relating to such work shall become non-refundable after commencement.
6.2 Duration and Additional Work
Unless otherwise agreed in writing, AI-generated videos or reels included within an approved package may have an approximate duration of 40–50 seconds.
Requests for longer duration, complete regeneration, fresh creative direction or substantial recreation may be treated as additional work and may involve additional charges.
- PAID ADVERTISING AND THIRD-PARTY EXPENDITURE
7.1 Agency Fee and Advertising Spend
Meta Ads, Google Ads and other advertising platform spends are separate from Brandtisers Media’s professional management fees unless expressly stated otherwise in writing.
Agency management fees shall be governed by the non-refundability provisions of this Policy once campaign-related work has commenced.
7.2 Advertising Budget
Where advertising spend is paid directly by the Client to Meta, Google or another advertising platform, any refund or adjustment relating to such amount shall be subject to the relevant platform’s policies and payment systems.
Where any advertising budget has been deposited with Brandtisers Media specifically for campaign expenditure, only the portion of the advertising budget that remains genuinely unspent at the time of an approved cancellation request may be eligible for return.
Any amount already spent, charged, consumed or committed to the advertising platform shall be non-refundable.
7.3 Third-Party Costs
Amounts paid or committed toward domains, hosting, SSL certificates, premium plugins, licences, software, APIs, stock assets, payment gateways, verification services or other third-party products and services shall not be refundable by Brandtisers Media once such charges have been incurred.
- WEBSITE DESIGN AND DEVELOPMENT
8.1 Advance Payment
A minimum advance of fifty percent (50%) of the approved website project cost shall be payable before planning, designing or development begins.
8.2 Cancellation Prior to Development
The Client may request cancellation and refund of the eligible advance amount where website planning, design or development has not yet commenced, subject to deduction of applicable expenses already incurred.
8.3 Cancellation After Commencement
Once website planning, design or development has commenced, the fifty percent (50%) advance payment shall become non-refundable.
8.4 Remaining Payment and Handover
The remaining fifty percent (50%) shall be payable before live deployment, migration, source-code delivery or transfer of administrative credentials, unless different written milestone terms have been approved.
Cancellation after substantial development or completion shall not remove the Client’s obligation to clear amounts payable for approved work already performed.
- SERVICE SUSPENSION AND CLIENT DISCONTINUATION
9.1 Suspension Due to Non-Payment
Where payment is not received by the applicable due date, Brandtisers Media may suspend ongoing services, campaigns, creative work, development work or delivery of files and credentials until all outstanding amounts have been cleared.
9.2 Effect of Suspension
A suspension caused by delayed payment, missing information, unavailable access or Client non-compliance shall not create any entitlement to a refund, credit, deduction, extension or carry-forward.
9.3 Early Discontinuation
Where the Client voluntarily discontinues an ongoing service after work for the relevant service cycle has commenced, fees already paid for that cycle shall remain non-refundable.
Any outstanding approved dues or additional charges incurred prior to discontinuation shall remain payable.
- CANCELLATION BY BRANDTISERS MEDIA
Brandtisers Media reserves the right to suspend or terminate an engagement where the Client fails to make payment, repeatedly fails to provide required cooperation or access, requests unlawful activity, violates platform policies, materially breaches the agreed terms or engages in abusive, threatening or inappropriate conduct toward Agency personnel.
Where termination occurs after work has commenced, payments relating to work already performed, resources allocated or expenses incurred shall remain non-refundable.
- REFUND REVIEW
Any refund request shall be reviewed according to the project status, commencement of work, payments received, third-party expenses incurred and the approved scope of services.
Submission of a cancellation or refund request shall not itself constitute approval of a refund.
Any refund, credit or commercial exception outside the provisions of this Policy shall be valid only where expressly approved in writing by an authorized representative of Brandtisers Media.
- GOVERNING LAW
This Refund & Cancellation Policy shall be governed by the laws of India.
Any dispute relating to cancellation, refund eligibility, payment or interpretation of this Policy shall be subject to the jurisdiction of the competent courts located in New Delhi, India.
- POLICY ACCEPTANCE
By proceeding with payment, project confirmation or service continuation, the Client acknowledges that they have read, understood and accepted this Refund & Cancellation Policy.
The Client further acknowledges that commencement of work may result in the applicable payment becoming non-refundable in accordance with the provisions stated above.
